1. 오늘 읽은 내용
Chap.3(Political Elements of Civilization 문명의 정치적 요소) 나머지 부분 Ⅱ. The State ~ Ⅲ. Law 을 읽었습니다. 제가 법학을 전공한 터라 법에 관한 서술 부분은 아주 관심있게 읽었습니다.
'법' 부분은 Law comes with property, marriage and government; the lowest societies manage to get along without it.(법은 재산, 결혼, 지배와 행동을 같이 한다 ; 가장 낮은 단계의 사회에서는 법 없어도 그럭저럭 잘 돌아간다)는 문장으로 시작합니다.
그리고 보강설명이 있습니다.
Natural societies are comparatively free from law first because they are ruled by customs as rigid and inviolable as any law; and secondly because crimes of violence, in the beginning, are considered to be private matters, and are left to bloody personal revenge.(자연상태의 사회가 법에서 상대적으로 자유로운 이유는, 첫째, 이들 사회가 어느 법보다 훨씬 엄격하고 신성하게 추앙받는 관습법의 지배를 받기 때문이며, 둘째, 폭력범죄는 애시당초 개인적인 문제로 간주되고, 이는 피로 얼룩진 개인적 복수의 영역이 되기 때문이다)
법의 발전단계에 관해서는 ① personal revenge(사적인 복수 단계) → ② the substitution of damages for revenge(복수 대신 대가를 치루게 하는 단계) → ③ the formation of courts(법정형성단계) → ④ the assumption, by the chief or the state, of the obligation to prevent and punish wrongs(범죄예방 및 처벌 의무가 지배자 또는 국가에게 독점인계되는 단계)로 설명하고 있었는데, 여느 형법교과서에 나오는 내용과 크게 다르지는 않았지만, 내용은 더 풍부한 듯한 느낌이 들었습니다.
하지만, 원시사회가 아무렇게나 행동하는 사회는 아니었으며, 오히려 행동반경에 상당히 많은 제약이 있었다고 합니다.
The primitive individual moves always within a web of regulations incredibly stringent and detailed ; a thousand tabus restrict his action, a thousand terrors limit his will.(원시사회의 개인들은 언제나 믿을 수 없을 정도로 엄격하고 상세한 규칙의 망속에서 움직인다 ; 수많은 금기가 행동을 제어하고 무수한 위협들이 그의 의지를 제약한다.)Unchangeable and unquestionable conventions determined the sitting and the rising, the standing and the walking, the eating, drinking and sleeping of the natives of Bengal. (벵골지방의 불변·불문의 관습법은 그 원주민들의 앉고 일어나는 방식, 서 있고 걷는 방식, 음식물 먹는 방식, 물 먹는 방식, 잠자는 방식을 규제했다)

시간은 모든 것을 신성하게 만드는 법이다 ; 가장 악명 높은 장물도, 그의 손자대에 있을 때에는 성스럽고 범접할 수 없는 재산이 되어 있기 마련이다.
A state which should rely upon force alone would soon fall, for though men are naturally gullible they are also naturally obstinate, and power, like taxes, succeeds best when it is invisible and indirect.
강제력에만 의존하는 국가는 곧 몰락하게 될 것인바, 천성적으로 인간들이 잘 속기는 하지만 또한 천성적으로 고집불통이기 때문이고, 세금과 마찬가지로 권력은 보이지 않고 간접적일 때 가장 성공적이기 때문이다.
Liberty is a luxury of security; the free individual is a product and a mark of civilization.
안전으로 누리는 호사가 자유다. 자유로운 개인은 문명의 산물이며 증거물이다.
